EO 14192 Unleashing Prosperity Through Deregulation

Description 

Executive Order 14192 directs federal agencies, including the U.S. Department of Education, to identify 10 existing regulations to be eliminated for every new regulation proposed, unless prohibited by law.  The reasoning is manage regulatory costs.  This order applies not only to regulations but also guidance documents that may not be subject to the Administrative Procedure Act (APA).

Action to be taken

  • Review existing regulations on accreditation, distance education, and state authorization to identify those with high compliance costs that could be candidates for repeal.
  • Evaluate new regulatory proposals to ensure they meet the requirement of eliminating ten existing regulations and demonstrate net cost savings.
  • Document and report cost impacts of digital learning regulations to comply with the Order’s cost-accounting framework.
  • Monitor agency actions for opportunities or risks related to higher education regulatory reform.
