Regulatory Guidance Relating to the Criteria and Process for Initial Recognition of an Accrediting Agency
Description
The U.S. Department of Education (Department) released an interpretive rule that serves as guidance to define key terms in regulation regarding the process for initial recognition of a new programmatic or institutional accreditor. This guidance aligns with goals presented in Executive Order 14279: Reforming Accreditation to Strengthen Higher Education.
The Department’s interpretation of key terms is intended to advance this Administration’s goal of reducing unnecessary barriers to the recognition of new accrediting agencies. Lowering these barriers further promotes competition in the marketplace of agencies responsible for assessing the quality of postsecondary institutions and programs.
By clarifying and implementing these definitions, the Department aims to streamline the recognition process and reduce the time required for new accreditors to progress through the necessary steps toward federal recognition.
Action to be taken
The Department's new interpretive rule is directed at accreditors and the Department's recognition process. However, institutions should be aware that the implementation of the rule could affect institutional accreditation options and timelines. Institutions may wish to:
- Monitor the recognition pipeline. Track new applicants and recommendations through National Advisory Committee on Institutional Quality and Integrity meetings and Department decisions. New accreditors may emerge more quickly than in prior cycles.
- Conduct careful risk analysis before considering an accreditor change. Evaluate Title IV implications, state authorization impact, reputational considerations, and the stability of newer agencies. Speed of recognition does not equal long-term durability.
- Engage state regulators early. States may respond cautiously to institutions accredited by newly recognized agencies, particularly in distance education contexts. Proactive communication reduces authorization risk.
- Brief governing boards. Accreditor choice is a governance-level decision. Boards should understand federal recognition status, transition risks, and potential regulatory scrutiny.
